Article 77. Article 81 No civil aircraft shall fly out of the-31-territorial airspace of the People's Republic of Chinaunless approved.Where a civil aircraft is leaving the airspace of thePeople's Republic of China without authorization, thedepartment concerned has the right to take necessarymeasures to stop it in accordance with concrete conditions.Section 3 Flight SupportArticle 82 An air traffic control unit shall provideair traffic services to civil aircraft in flight, includingair traffic control service, flight informationservice and alerting service.The purpose of providing air traffic control serviceis to prevent collisions between civil aircraft and aircraft,and between civil aircraft and obstacles, andmaintain and expedite an orderly flow of air traffic.The purpose of providing flight information serviceis to provide advice and information useful for thesafe and efficient conduct of flights.The purpose of providing alerting service is to notifyappropriate organizations regarding aircraft in needof search and rescue aid, and assist such organizationsas required.Article 83 In the event that an air traffic controlunit discovers a civil aircraft deviated from its-32-specified air route or lost its course, it shall rapidlytake all necessary measures to enable the aircraft toregain course.帅哥 发表于 2008-12-31 02:43:15
Article 84 Necessary navigation, communication,meteorological and ground monitoring equipmentsshall be installed on the air route.Article 85 The natural obstacles that affectflight safety on air route shall be marked on aeronauticalcharts; flight obstacle lights and marks shall be installedon man-made obstacles that affect flight safetyon air route and shall be kept in normal condition.Article 86 The construction of a shooting rangeor other facilities that will possibly affect flight safety isprohibited within the area extending 30 kilometersfrom the edges of an air route, unless it is a shootingrange for flat trajectory light weapon.The construction of a fixed or temporary air shootingground beyond the area prescribed in the precedingparagraph shall be subject to approval according to relevantState regulations; the shooting direction of an airshooting range shall not intersect an air route.Article 87 Any activity that will possibly affectflight safety may be carried out only after being approvedaccording to law with necessary measures beingtaken to ensure flight safety.-33-帅哥 发表于 2008-12-31 02:43:26
Article 88 The competent civil aviation authorityunder the State Council shall exercise control overcivil aviation radio stations and the special frequenciesassigned to be used by civil aviation system accordingto law.No radio station or other instrument and deviceused by a unit or an individual shall hinder the normaluse of civil aviation special radio frequencies. Whereharmful interference has been caused to civil aviationspecial radio frequencies, the unit or individual concernedshall rapidly remove such interference; the use ofsuch radio station or other instrument and device shallbe stopped before the removal of the interference.Article 89 The post and telecommunication enterpriseshall give priority in service to civil aviationtelecommunication transmission.The State meteorological organ shall provide necessarymeteorological data to civil aviation meteorologicalorgan.Section 4 Essential Documentsfor FlightArticle 90 A civil aircraft engaged in flight operationshall carry the following documents:(1) Civil aircraft certificate of nationality registration;-34-(2) Civil aircraft certificate of airworthiness;(3) Appropriate licences for crew members;(4) Civil aircraft journey log book;(5) If the civil aircraft is equipped with radio apparatus,its radio station licence;(6) If the civil aircraft carries passengers, a list oftheir names and places of embarkation and destination;(7) If the civil aircraft carries cargo, a manifest anddetailed declarations of the cargo; and(8) Other documents that should be carried accordingto the flight mission.Where a civil aircraft fails to carry the documentsas listed in the preceding paragraph according to regulations,the competent civil aviation authority under theState Councilor the regional civil aviation administrativeorgan authorized by it may prohibit such civil aircraftto take off.帅哥 发表于 2008-12-31 02:43:39
Chapter VIIIPublic Air Transport EnterpriseArticle 91 "Public air transport enterprise"means a corporate enterprise engaged in the transportof passengers, baggage, mail or cargo with civil aircraftfor the purpose of making profit.Article 92 In establishing a public air transport-35-enterprise, application shall be filed with the competentcivil aviation authority under the State Council for operatinglicence, and registration with the administrativedepartment for industry and commerce shall be performedaccording to law; where a public air transportenterprise fails to obtain operating licence, no registrationshall be performed for such enterprise by the administrativedepartment for industry and commerce.Article 93 The establishment of a public airtransport enterprise shall satisfy the following conditions:(1) It has the civil aircraft conforming to the requirementsof ensuring flight safety as stipulated by theState;(2) It has the necessary airmen who have been issuedlicences according to law;(3) It has the registered capital not less than theminimum limit prescribed by the State Council; and(4) Other conditions prescribed by laws and administrativerules and regulations.帅哥 发表于 2008-12-31 02:43:51
Article 94 The provisions of the Company Lawshall be applicable to the form of organization andinstitutional framework of public air transport enterpnses.Where the form of organization and institutionalframework of the public air transport enterprises establishedbefore the implementation of this Law do not-36-completely conform to the provisions of the CompanyLaw, original provisions can continue to be followed,and the date of the application of the provisions in thepreceding paragraph shall be specified by the StateCouncil.Article 95 A public air transport enterpriseshall take the assurance of flight safety, the regularity offlight and the provision of good service as guiding principles,and take effective measures to improve transportservice quality.A public air transport enterprise shall educate andrequire its staff and workers to strictly perform theirduties, and conscientiously accomplish the services oftransporting passengers and cargo with refined mannersand thoughtfulness.In the event of delay in passenger transport flight,relevant information shall be announced in time in theairport.Article 96 A public air transport enterpriseshall apply to the competent civil aviation authorityunder the State Council for approval with respect to theair route to be operated for scheduled air services, andthe suspension or termination of the operation of airroute.A public air transport enterprise operating scheduledair services shall have its timetable published.-37-帅哥 发表于 2008-12-31 02:44:02
Article 97 The chargeable business items of apublic air transport enterprise shall be determined bythe competent civil aviation authority under the StateCouncil.The measures for the control of tariff of domesticair transport shall be formulated jointly by the competentcivil aviation authority under the State Council andthe competent authority of prices under the StateCouncil, and shall be implemented after being approvedby the State Council.The tariff of international air transport shall beimplemented in accordance with the provisions of theagreements signed between the Government of thePeople's Republic of China and foreign governments; inthe absence of any agreement, the tariff shall be formulatedwith reference to the market prices of internationalair transport, and shall be implemented after beingapproved by the competent civil aviation authority underthe State Council.
