2002年至2004年的民航改革，使全行业进一步呈现持续、快速、健康、协调发展的态势，但影响民航发展的深层次矛盾和问题没有完全解决，新的矛盾和问题也在不断出现。无论在政府管理层面、行业组织层面还是企业经营层面依然存在与民航快速发展不相适应的矛盾。继续深化改革，为行业发展提供体制和机制保障依然是今后一段时期保证行业发展的必要工作。2005年，民航总局就深化改革问题进行了深入的调研，全行业也开展了深入的讨论，在此基础上，民航总局初步制定了《深化民航改革指导意见》，提出了“十一五”期间全行业进一步深化改革的指导思想，改革内容、思路、措施。<o:p></o:p>

继续按照“积极、有序、渐进、有保障”的原则，在推进双边航空关系的基础上，以我与东盟航空运输安排框架为试点，启动区域/多边航空运输安排机制，全方位发展民航对外关系。<o:p></o:p>
为解决我国国际航空运输存在的总量规模偏小、航线分布不均、枢纽港建设和配套措施滞后以及国际竞争力不强等制约因素，2005年民航总局出台了促进我国国际航空运输发展的一揽子指导政策<A title="" style="mso-endnote-id: edn4" href="http://www.minhang.cc/post.php?action=reply&fid=165&tid=7244366&extra=page%3D1#_edn4" name=_ednref4><SPAN lang=EN-US style="FONT-SIZE: 15pt; FONT-FAMILY: 仿宋_GB2312; mso-font-kerning: 1.0pt; mso-bidi-font-family: 宋体; mso-hansi-font-family: 宋体; mso-ansi-language: EN-US; mso-fareast-language: ZH-CN; mso-bidi-language: AR-SA"></A>。包括：实施分阶段开放我国航空运输市场、优先开放国际航空货运市场、支持中西部和东北地区发展国际航空运输、促进门户枢纽机场建设的政策；建立公平、公正、公开的定期国际航班经营许可申请和审批机制，改革定期国际航班加班和包机的审批制度；设立国际航空运输发展特殊风险财政机制，鼓励和扶持航空公司开辟市场需求少且是国家外交需要的国际航线；建立和完善航班时刻管理、全球分销系统管理、机场地面服务等领域的法规建设；配套实施推进国际航空运输简化手续工作、推广电子客票、协调降低有关环节税费等措施。同时民航总局成立了“促进国际航空运输发展领导小组”，改革和协调国际国内航空运输发展政策，负责各项政策措施的落实；明确了各地区管理局国际航空运输市场监管的职能。<o:p></o:p>

在内地与港、澳地区更紧密经贸关系安排（CEPA）框架下，允许香港、澳门服务提供者以跨境交付、合作、合资或独资形式提供中小机场委托管理服务，合同有效期不超过20年；允许香港、澳门服务提供者以跨境交付、境外消费、合作、合资或独资形式提供机场管理培训、咨询服务；允许香港、澳门服务提供者以合资或独资形式在内地提供代理服务、装卸控制和通信联络及离港控制系统服务、集装设备管理服务、旅客与行李服务、货物与邮件服务、机坪服务、飞机服务等七项航空运输地面服务<A title="" style="mso-endnote-id: edn5" href="http://www.minhang.cc/post.php?action=reply&fid=165&tid=7244366&extra=page%3D1#_edn5" name=_ednref5><SPAN lang=EN-US style="FONT-SIZE: 15pt; FONT-FAMILY: 仿宋_GB2312; mso-font-kerning: 1.0pt; mso-bidi-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman'; mso-ansi-language: EN-US; mso-fareast-language: ZH-CN; mso-bidi-language: AR-SA"></A>。在2005年的CEPA第三阶段磋商中，向港澳服务提供者进一步开放了航空运输销售代理业，允许港澳服务提供者在内地设立合资、合作航空运输销售代理企业，注册资本要求与内地企业相同。<o:p></o:p>

<st1:chsdate w:st="on" Year="1998" Month="3" Day="5" IsLunarDate="False" IsROCDate="False">1998年3月5日</st1:chsdate>民航总局试行《民用航空飞行签派服务代理工作管理规定》，要求各航空公司在外站选择经审定合格的签派服务代理人提供服务，民航地区管理局负责对辖区内的代理人进行资格审定。随着航空公司机队的扩大，这种做法导致了有些航空公司通过签订协议完全将签派放行责任交给了代理部门，失去了对飞行运行的签派放行和控制权等问题。鉴于《公共航空承运人运行合格审定规则》（CCAR-121部）已明确了航空承运人的运行控制责任，对于外站运行，航空承运人可以直接派送合格的人员到外站完成运行控制工作，也可以通过签订协议委托代理机构或人员将飞行资料传递给机组。委托他人为机组提供服务是航空承运人的内部行为，代理人的行为视为航空承运人的行为，航空承运人应当对代理人的行为负责。因此，从<st1:chsdate w:st="on" Year="2005" Month="7" Day="1" IsLunarDate="False" IsROCDate="False"><st1:chsdate w:st="on" Year="2005" Month="7" Day="1" IsLunarDate="False" IsROCDate="False">2005年7月1日</st1:chsdate>起</st1:chsdate>，民航废止了《民用航空飞行签派服务代理工作管理规定（试行）》。有关运行控制和签派放行工作严格按照121部实施，航空公司在外站委托签派服务代理的名称改为“外站航务服务”。<o:p></o:p>

随着近几年民航业的快速发展以及一批新的航空公司进入市场，飞行员短缺现象日益突出。为进一步规范民航飞行人员流动管理，保证飞行队伍稳定，确保飞行安全，民航总局会同人事部、劳动部、国资委和国务院法制办认真研究，及时出台指导政策，规范飞行人员流动<A title="" style="mso-endnote-id: edn16" href="http://www.minhang.cc/post.php?action=reply&fid=165&tid=7244366&extra=page%3D1#_edn16" name=_ednref16><SPAN lang=EN-US style="FONT-SIZE: 15pt; FONT-FAMILY: 仿宋_GB2312; mso-font-kerning: 1.0pt; mso-bidi-font-family: 宋体; mso-hansi-font-family: 宋体; mso-ansi-language: EN-US; mso-fareast-language: ZH-CN; mso-bidi-language: AR-SA"></A>。要求对招用其他运输航空公司在职飞行员的，应当与飞行员所在单位进行协商并达成一致，参照70-210万元的标准向原单位支付费用。在确定具体补偿费用标准时，原则上以飞行人员初始培养费70万元为基数，从飞行员参加工作开始，综合考虑后续培养费用，以年均20%递增计算补偿费用，最高计算10年，即最高补偿费用为210万元。45岁以后再从210万元开始，以70万元为基数，以年均20%递减计算补偿费用。航空企业招用其他通用航空企业在职飞行人员的，根据现行通用航空企业招收录用培训飞行人员的实际费用情况，参照50-110万元的标准向原单位支付费用，即以初始培养费用50万元为基数，按年均15%递增计算补偿费用，最高计算8年，最高补偿费用为110万元。40岁以后再从110万元开始，以50万元为基数，按年均15%递减计算补偿费用。对飞行安全上发生问题的飞行人员，在问题处理过程中，未经用人单位同意，不得调离。对因政治、组织纪律、飞行作风、安全事故、技术等原因被停飞的飞行人员，必须经民航总局批准后，才能在运输航空公司恢复飞行。此外，还要求：要加强航空运输企业的劳动合同管理，建立健全有关规章制度；要进一步深化工资分配制度改革，工资分配向一线飞行人员倾斜；要进一步完善飞行人员的飞行准入和资质管理；加大民航飞行人员的培养力度，探索建立飞行人员市场化的培养机制，探索建立多渠道、多层次、多元化的飞行人员市场化培养途径。<o:p></o:p>

航班正常是民航优质服务工作的一个重要体现,民航总局将提高航班正常作为2005年的一项重要工作<A title="" style="mso-endnote-id: edn41" href="http://www.minhang.cc/post.php?action=reply&fid=165&tid=7244366&extra=page%3D1#_edn41" name=_ednref41><SPAN lang=EN-US style="FONT-SIZE: 15pt; FONT-FAMILY: 仿宋_GB2312; mso-font-kerning: 1.0pt; mso-bidi-font-family: 宋体; mso-hansi-font-family: 宋体; mso-ansi-language: EN-US; mso-fareast-language: ZH-CN; mso-bidi-language: AR-SA"></A>。明确各航空公司是保证航班正常的责任主体，要求各航空公司全面落实航班正常工作责任制，切实降低因航空公司自身原因造成的航班延误，尤其是公司计划原因造成的航班延误；大力降低航班平均延误时间，搞高航班运行品质；进一步完善航班延误处置机制，与其它保障单位共同做好延误航班的服务工作。要求空管部门、机场和其它部门切实承担起保障航班正常的责任，为航空公司运行创造良好的秩序和环境。同时，通过有关新闻媒体定期公布各航空公司航班正常率，发挥社会舆论监督的作用。实行航班正常率与航线航班经营许可审批挂钩的机制。对航班正常率低于80％的航空公司，以及因公司自身原因造成航班经常延误，或长时间延误航班处置不力造成恶劣影响的，在全行业内进行通报批评并加大处罚力度。2005年，在航班总量大幅度增加、空域更加紧张、非民航飞行活动影响增大的情况下，全年航班正常率达到81.99%，比上年提高了2.1个百分点，各公司航班正常率都达到或高于81%，实现了全行业航班正常率80％的目标。<o:p></o:p>
