Each petition for an exemption should be submitted to the Rules Docket Clerk in accordance with Part 11 – Procedures for Making Ordinary Rules and Granting Exemptions. Forms are available on the CAA web site (refer Legislation – Forms). The CAA welcomes your comment in writing or by e-mail on any of the petition requests for exemptions listed. Summary of Exemption Petitions Received Nil Directors action on external petitions for exemptions 4/EXE/13 - Simuflight (NZ) Ltd Civil Aviation Rule 61.105(2) - requirement to hold a current medical certificate issued under the Act. The Director granted an exemption to named Student Pilots from the requirement in Civil Aviation Rule 61.105(2) that a person who does not hold a current pilot licence issued under Part 61 shall not fly an aircraft solo unless that person holds at least a current Class 2 medical certificate issued under the Act, provided that— (a) the Student Pilot holds a current Joint Aviation Authorities Class 1 medical certificate and continues to comply with all medical endorsements on the medical certificate; and (b) the Student Pilot is undergoing flight training conducted by Simuflight (NZ) Ltd, and (c) should the Student Pilot become aware of, or has reasonable grounds to suspect, any change in his or her medical condition or the existence of any previously undetected medical condition the student must— (i) advise the Director of the change as soon as practicable; and (ii) not fly an aircraft solo unless authorised to do so in writing by the Director; and (d) the Student Pilot complies with any conditions or restrictions that may be imposed by the Director under (c)(ii). This exemption and schedule of named student pilots remains in effect for 6 months from the date of issue unless the schedule is amended or the exemption is withdrawn earlier in writing by the Director. Dated 22 October 2003 2/EXE/32 - Air New Zealand Ltd Civil Aviation Rule 91.111(a)(2) – Documents to be carried. The Director granted an exemption to Air New Zealand Ltd from requirement in Civil Aviation Rule 91.111(a)(2) that the flight manual must be carried in an aircraft, only with respect to Boeing B747, B767, B737-300 and Airbus A320 aircraft operated in accordance with air operator certificate number AOC 12861 issued by the Director of Civil Aviation to Air New Zealand Ltd, Edition 2003- 12 6 November 2003 Provided that the following documents produced by Air New Zealand Ltd applicable to the aircraft type are carried on the aircraft: (a) for Boeing B747, B767 and B737-300 operations: (i) Operations Manual Volume 1; (ii) Quick Reference Handbook; (iii) Performance Manual; (b) for Airbus A320 operations: (i) Flight Crew Operations Manual Volume 2; (ii) Flight Crew Operations Manual Volume 3; (iii) Quick Reference Handbook. This exemption remains in effect unless withdrawn in writing by the Director. Dated 22 October 2003 Emergency Rule making activity Under section 31 of the Civil Aviation Act the Director may make emergency Civil Aviation Rules as may be necessary to alleviate or minimise any risk of the death of or serious injury to any person, or of damage to any property. Nil Rule making activity The statutory power to make Civil Aviation Rules rests with the Minister of Transport under Part 3 of the Civil Aviation Act 1990. The CAA is contracted to the Ministry of Transport to develop Rules for the Minister. Under the contract the Minister of Transport approves a programme of new Rules, and changes to existing Rules for the financial year. The programme is based on the CAA proposals and proposals from other interested parties. See summary of Rule activities attached. Notification of Ordinary Rules Docket 1/CAR/1358- Agricultural Aircraft Operations The Associate Minister of Transport signed the following Rule amendments on November 4. The rule will come into effect on 12 December 2003 Part 137 Re-issue, and Part 1 Amendment 24 The changes proposed provide additional requirements and exceptions to the general operating rules for the conduct of agricultural aircraft operations within New Zealand. Part 1 provides the definition of what is meant by agricultural aircraft operations. Edition 2003- 12 6 November 2003 Docket 2/CAR/9 – Transition Rules The Associate Minister of Transport signed the following Rule amendment on November 4. The rule will come into effect on 12 December 2003 Part 19 Amendment 5 The objective of Amendment 5 to Rule Part 19 is to prescribe conditions for the use of Global Positioning System (GPS) derived distance information during a precision instrument approach. Petitions for Rule making 98/PET/54 New Zealand Air Line Pilots’ Association – One level of safety The New Zealand Air Line Pilots’ Association (NZALPA) submitted a petition dated 18 December 1997 to propose that the scope of Part 121 be widened to include all aeroplanes having 10 passenger seats or more. This petition with relevant CAA comment was published in the CARRIL on 4 September and 2 October 2003, with the comment period open until 31 October 2003. Six comments had been received as at 31 October 2003. CAA will review these and make a determination which will be published in the CARRIL. Petitions Declined Nil Other Rule Activity Nil Notice of Proposed Rule Making (NPRM) Docket 98/CAR/1304–NPRM 04-01 Designation and Classification of Airspace CAR Part 71–Designation of Airspace CAR Part 73–Special Use Airspace Purpose of NPRM: • Combine Parts 71 and 73 into one Part. • Propose changes to various airspace designation and classification rules, including an expansion of the criteria for the Director to designate transponder mandatory airspace to allow for the more effective use of airborne collision avoidance systems (ACAS). • Incorporate changes to airspace terminology arising from harmonisation discussions with the Civil Aviation Safety Authority Australia (CASA). This proposal also includes consequential airspace related amendments to other Parts, and makes editorial changes to rules 91.307 and 91.311. Edition 2003- 12 6 November 2003 Key Issues The proposal will: • Reduce the number of airspace rules • Reduce the number of special use airspace types • Introduce common terminology as a consequence of airspace terminology harmonisation discussions with CASA • Clarify the intent of certain airspace related rules • Raise the transition altitude • Extend the criteria for the Director to designate transponder mandatory airspace to provide for the more effective use of ACAS • Remove differences between Part 71 and ICAO Annex 11. Consultation Considerable public and industry consultation on various issues has already taken place prior to and during the development of this NPRM. This consultation included: • The public consultation that took place on the original NPRM 99-5 issued in 1999, and the consequential meetings and discussions with GNZ and ACNZ • The airspace harmonisation discussions that took place with CASA over the period December 2000 to July 2001 • Discussions on transponder mandatory airspace during the Part 121 and Part 125 ACAS rules development projects during 2001 and 2002 • The extensive consultation that took place with various aviation user groups and industry representatives during 2001/02 in association with the Airspace Review conducted by the CAA Aeronautical Services Unit. NPRM 04-01 was first notified in a special edition of the CARRIL on 16 October 2003 and is available on the CAA web site and on request to the Docket Clerk. Edition 2003- 12 6 November 2003 CIRAG CIRAG is the acronym for the joint Civil Aviation Authority (CAA) and Industry Rules Advisory Group. It is part of the Rule making process to involve industry representation in the development of new or amended Rules. Details about CIRAG’s structure and mechanism are available on the CAA web site http://www.caa.govt.nz under the Rules & more heading, or from the Docket Clerk. The CIRAG Executive consists of three AIA/industry members Wayne Taylor, Geoff Eban and John Funnell; and three CAA members, Steve Douglas, Peter Blackler and the relevant General Managers of Airlines, General Aviation or Personnel Licensing and Aviation Services Groups. The CIRAG Executive last met on 2 October 2003 to review the progress of the various Technical Study Group (TSG) projects. The Minutes of the 18th Meeting of the CIRAG Executive held on 2 October 2003 will be available on the web shortly. The next meeting of the CIRAG Executive is scheduled for 18th December 2003. Edition 2003- 12 6 November 2003 Summary of Rule Development Projects 2003/04 Programme: Rules Development Services Activity Report at 31 October 2003 Rule Name & Project Reference Description & purpose of the rule Rules Development Activity for month end 31 October Current Status CA1 Part 43: General Maintenance Rules (1/CAR/1357) Continuation of work to amend various rule parts relating to aircraft maintenance & airworthiness requirements. The proposed alterations are based upon CAA findings, industry submissions & other editorial changes • Review of amendments proposed for Part 43 and Part 91 • Finalisation of background information required to support the proposed amendments • Discussion with various industry participants • Further meetings with Operational Groups within CAA to finalise reasons and background information required to support proposed rule changes. NPRM development Draft NPRMs being finalised by Contract Rules Specialist to ensure that appropriate supporting information for the rule changes is included in the NPRM. CA2 Part 61: Pilot licences & ratings (2/CAR/1) Continuation of work to review and update the requirements and standards for the issue of pilot’s licences and the associated ratings and authorisations and to prescribe the associated privileges that the license holder may exercise. Development of draft NPRM for first stage of implementation plan. Review of draft NPRM by Personnel Licensing Unit and modification of some parts. Initial CAA legal review completed. Internal CAA meeting held to formulate Recreational Pilot Licence requirements and actions required. Five Part 61 Advisory Circulars have been updated including new knowledge syllabus and subject numbers in preparation for publication. NPRM development Project split into 3 stages. TSG meeting held 25 Sept. Draft NPRM for stage 1 updated following input from Personnel Licensing and operating groups. Draft NPRM to be finalised for CAA legal and policy review before going to MOT mid Nov. CA3 Part 141: Aviation Training Organisations Certification Continuation of work to amend Part 141 to provide for two levels of organisation certification to give effect to the requirements that arise for the review of Part 61 for pilot training to be conducted by certificated training organisations. Nil Follow on from Part 61 review. Work on this project will not commence until stage 3 of the Part 61 project which will deal with certification for pilot training organisations. CA4 Part 71/73: Designation and classification of Airspace (98/CAR/1304) Continuation of work to update the rules for the designation and classification of airspace by the Director. The project combines two rule parts into one part, harmonises terminology with the Australian Rules and allows for the effective use of airborne collision avoidance systems. Recording, analysing and responding to comments on NPRM. Public Consultation NPRM issued for public consultation on 16 Oct 2003. Comments close 14 Nov 2003. CA5 Part 139: Aerodromes- Certification, Operation & Use; Runway End Safety Area (RESA) (4/CAR/2) Continuation of work to update the Standards and Regulatory requirements relating to the certification and operation of aerodromes, to implement the ICAO requirements and standards for RESA at aerodromes with regular international air transport operations. Consequential amendments will reflect into Parts 1, 121, 125, 135 and 129 Legal research and analysis for NPRM development continued. Consultation with TSG continued. Draft NPRM completed and CAA legal review completed. Update research into FAA requirements Continue to receive feedback on rule proposals. Draft NPRM awaiting policy review. This will remove the need for ground based measuring equipment to be installed in light airplanes, thereby reducing compliance costs for about 20 new aircraft/year. • Print, check and deliver Final Rule Goatskin documents to MoT. CA10 Parts 121, 125, 135 – Passenger, crew member and baggage weights (2/CAR/5) Passenger Survey (4/RRP/2) Final stage of project to review and update those rules relating to calculating the take off weight of aircraft involved in air operations using standardised passenger, crew member and baggage weights. CAA Legal review and sign-off of draft final rule. Passenger weight survey commenced in Queenstown on 9 Oct but later deferred due low passenger numbers. Passenger weight surveys completed at Auckland and ongoing in Christchurch, Wellington and Queenstown. Draft Final Rule Passenger weight survey at various airports being conducted during Oct/Nov. Survey final report due 30 Nov. Draft final rule will be updated with mean passenger weight from survey. Final legal review completed Awaiting GMA and GM GA sign-ff. CA11 Part 137 – Agricultural Aircraft (1/CAR/1358) This will include more prescriptive requirements relating to the maximum load specifications for some agricultural aircraft & the jettison capacity of aircraft, as well as some editorial changes. Part 121 Complete Rule amendments came into force 1 Aug 2003. Part 125 Final Rule 11 September Associate Minister briefed on updated CBA costs and consequential effect on airlines involved. 25 September affected airlines and AIA together with CAA and MoT met with Associate Minister regarding retrofitting Part 125 10 – 19 seat aeroplanes with TAWS A. Industry response from those affected operators (10-19 seats), to be forwarded to Associate Minister by 3 Nov 2003 CA13 Part 95/173 – Instrument flight procedures/Air navigation service organisations (99/CAR/1333) (99/CAR/1334) New rule to establish standards for design of instrument procedures and for certification of design organisations. This will ensure that the integrity of instrument procedures is maintained. Archiving and rationalisation of project records. Legal review and proposal updated. Ongoing external consultation continued. Consequential editorial amendments to Parts 19, 91, 121, 125, 135, and 172 incorporated into draft final rule document. Part 21 - Certification of products & parts Review of the categorisations for special category aircraft, the requirements for certification, and operating limitations This project will be progressed in conjunction with the implementation of the Scholtens recommendations Update of Offences Regulations A review and update of Schedule 1 of the Civil Aviation (Offences) Regulations has been completed and forwarded to MoT for passing onto Parliamentary Counsel Office. This involved a review of all the current Civil Aviation Rules and the development of a complete replacement of Schedule 1 of the (Offences) Regulations instead of trying to develop individual amendment instructions. The Offences Regulations have not been amended since they first came into effect in 1997. During the intervening period various new rules have come into force and many others have been amended.
